1. About BESMUG
BESMUG & Co (“BESMUG”, “we”, “us”, “our”) operates India's first dedicated marketplace for sustainable products and services. BESMUG is a platform that connects buyers and sellers — we are not a party to transactions between them.
2. Eligibility
You must be at least 18 years of age and legally capable of entering into contracts to use BESMUG. By using the Platform you represent that you meet these requirements and that the information you provide is accurate and complete.
3. Seller Terms
As a seller on BESMUG, you agree to:
- List only products and services that are genuinely sustainable, eco-friendly, or aligned with ESG principles.
- Provide accurate, truthful descriptions, pricing and certifications. No greenwashing.
- Hold all required licences, certifications and permissions to sell your listed products.
- Respond to buyer enquiries within a reasonable timeframe (we recommend 24 hours).
- Not list prohibited items (see Section 6).
- Accept that BESMUG may verify your listing and place it under review before going live.
- Acknowledge that BESMUG currently charges no listing fee or commission, though this may change with prior notice.
4. Buyer Terms
As a buyer on BESMUG, you agree to:
- Use the Platform only for lawful purposes.
- Contact sellers only with genuine purchase or business enquiries.
- Conduct your own due diligence on sellers before entering any transaction. BESMUG facilitates discovery only.
- Not misuse the enquiry system to spam or harvest seller contact details.
BESMUG is not responsible for the quality, safety, or delivery of products listed. All transactions are directly between buyers and sellers.
5. Verification and Moderation
BESMUG reviews all product listings before making them active. We reserve the right to:
- Decline or remove any listing that does not meet our sustainability standards.
- Request additional documentation to verify sustainability claims or certifications.
- Suspend or terminate accounts that violate these Terms.
- Mark listings as “Verified” only after completing our review process.
Decisions on listing approval are at BESMUG's sole discretion. We are committed to maintaining the integrity of India's first dedicated green marketplace.
6. Prohibited Listings
The following are not permitted on BESMUG:
- Products making false or unsubstantiated environmental claims (greenwashing).
- Products that are harmful to human health or the environment.
- Counterfeit goods or items infringing intellectual property rights.
- Products prohibited under Indian law.
- Non-sustainable products listed under sustainable categories.
- Duplicate or spam listings.
7. Intellectual Property
All content on BESMUG — including design, code, logos, and editorial copy — is owned by or licensed to BESMUG & Co and protected under applicable intellectual property laws.
By submitting a listing, you grant BESMUG a non-exclusive, royalty-free licence to display, reproduce and promote your listing content (including images and descriptions) on the Platform and in marketing materials.
You retain ownership of your listing content. You represent that you have the right to grant this licence.
8. Limitation of Liability
BESMUG is a discovery and connection platform. We are not a party to any transaction between buyers and sellers. To the maximum extent permitted by law:
- BESMUG is not liable for any loss arising from transactions between buyers and sellers.
- BESMUG makes no warranties about the accuracy of product descriptions or certifications submitted by sellers.
- BESMUG is not liable for indirect, incidental or consequential damages arising from use of the Platform.
9. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in India.
10. Changes to Terms
We may update these Terms from time to time. Significant changes will be notified by email or by a notice on the Platform. Continued use of BESMUG after changes constitutes acceptance of the updated Terms.
